Terms of Service
Last updated
The short version:
- Free modules are free to use under the license in each module’s repository.
- Buying a premium module gives you a personal license to use it in your own games. Please don’t share or resell it.
- Refunds are decided case by case. Email contact@elderlabs.dev.
- Suggest a module, and if we build it, you get it free.
- Elder Labs isn’t affiliated with Foundry Gaming LLC, the makers of Foundry Virtual Tabletop.
These terms are an agreement between you and Elder Labs LLC (“Elder Labs”, “we”, “us”), a New Mexico limited liability company, for using elderlabs.dev (the “Site”) and the modules we offer. By using the Site, creating an account or buying a module, you agree to them. Our Privacy Policy explains how we handle your information.
Your account
- You need an account to buy premium modules. You can sign in with an email link, Discord or Google.
- Keep access to that email or account safe: anyone who can use it can sign in as you. Tell us if you think someone else has.
- You must be at least 13, and old enough to make purchases where you live.
- You can delete your account at any time from your Library. Deleting it ends your access to the premium modules you bought.
Free modules
Free modules are provided at no cost under the license stated in each module’s source repository. That license, not these terms, says what you may do with the module’s code.
Premium modules
Your license
When you buy a premium module, we give you a personal, non-exclusive, non-transferable license to install and use it in Foundry Virtual Tabletop for games you run or play in, including with your players. The license lasts as long as you follow these terms. We, or our licensors, keep all rights in the modules.
You may not:
- share, resell, sublicense or publish the module, its files or its install links;
- remove license or copyright notices, or get around the way the module is delivered or protected;
- use the module’s code or assets to create a competing product, except as the law allows.
Delivery and updates
Premium modules are delivered through your Library on the Site. We release updates when we can, including for new Foundry versions, but we can’t promise a module will keep working with every future version of Foundry VTT, game systems or other modules.
Prices and payment
Prices are shown in US dollars and may change, but a change never affects a purchase you’ve already made. Payments are processed by Stripe. You’re responsible for any taxes your purchase is subject to where you live.
Refunds
We consider refund requests case by case. If something isn’t working for you, email contact@elderlabs.dev with your order details and we’ll do our best to help. Nothing here limits refund rights your local consumer law gives you. When a purchase is refunded, the module is removed from your Library and your license to it ends.
Module suggestions
You can suggest modules from the home page. Ideas are welcome, but sending one doesn’t oblige us to build it, and others may suggest similar ideas or we may already be working on them. You let us use, change and build on what you send, without owing you anything beyond what this section promises.
If we release a module based on your suggestion, you get it free. We’ll add it to your Library at no cost, even if it’s a premium module. If several people suggest the same idea, the first suggestion we received counts. We decide whether a module is based on a suggestion. The reward is tied to the account you suggested from, so it doesn’t apply if that account has been deleted.
Using the Site
Please don’t:
- break the law or anyone else’s rights through the Site;
- try to break into, overload, scrape at scale or otherwise disrupt the Site or other people’s accounts;
- use someone else’s account or payment method without permission.
We may suspend or close accounts that break these terms. If we close your account for a reason other than a breach, we’ll refund premium modules you can no longer use.
Other websites and services
The Site links to websites and services we don’t run, such as the services we list, Foundry VTT, GitHub, Discord and YouTube. Their own terms apply when you use them, and we’re not responsible for them.
Trademarks
Foundry Virtual Tabletop is a trademark of Foundry Gaming LLC. Elder Labs is an independent developer and isn’t affiliated with or endorsed by Foundry Gaming LLC. Other names and trademarks belong to their owners.
Disclaimers
The Site and the modules are provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise the Site or a module will be uninterrupted or error-free. Back up your Foundry worlds before installing or updating modules.
Limitation of liability
To the fullest extent the law allows, Elder Labs won’t be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill. Our total liability for any claim about the Site or the modules is limited to the amount you paid us in the 12 months before the claim. Some places don’t allow these limits, so they may not all apply to you.
Governing law
These terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in New Mexico, unless your local consumer law gives you the right to bring it where you live.
Changes
We may update these terms. We’ll change the date at the top, and say so on the Site before a significant change takes effect. Continuing to use the Site after that means you accept the new terms. Changes never take away a license you’ve already bought.
